1. Ownership of the website

In compliance with the duty of information established in article 10 of Ley 34/2002, de 11 de julio, de Servicios de la Sociedad de la Información y de Comercio Electrónico (Spanish Information Society Services and E-Commerce Act, “LSSI-CE”), the following identifying details of the owner of this website are set out below:

The owner acts as a natural person under the self-employed professional (autónomo) regime. “UnoRed” is a trade name used by the owner in the course of his activity and does not, at present, constitute a separate legal entity.

Continuity of the business. The owner intends to incorporate a company that will continue the business under the name UnoRed. When that happens, only the identifying details in this section will change. The change will not affect contracts already signed with clients, which will remain fully in force on the same terms and will be understood to refer automatically to the new company, with no document to sign and nothing for the client to do, under the assignment clause in their agreement.

2. Purpose and acceptance

This Legal Notice governs access to, browsing of and use of the website unored.es and all of its subdomains and sections (hereinafter, the “Website”), without prejudice to any particular conditions that the owner may establish for specific services.

Access to the Website confers the status of user (hereinafter, the “User”) and implies full and unreserved acceptance of each and every provision of this Legal Notice, of the Privacy Policy and of the Cookie Policy, in the version published at the time of access. If the User does not agree with their content, the User must refrain from using the Website.

3. Intended recipients: site directed exclusively at professionals and businesses

The Website and the services offered through it are directed exclusively at businesses, professionals, self-employed professionals and legal entities acting within the framework of their business or professional activity. They are not directed at consumers within the meaning of article 3 of Real Decreto Legislativo 1/2007, de 16 de noviembre, approving the consolidated text of the Ley General para la Defensa de los Consumidores y Usuarios (the Spanish Consumers and Users Act).

The Website is not directed at minors. The owner does not knowingly collect data from persons under eighteen (18) years of age.

By using the forms on the Website or requesting any service, the User declares that he or she is acting in his or her own name or as a duly authorised representative of a company or professional activity, and that he or she has sufficient legal capacity to do so.

4. Languages of the Website — the Spanish version prevails

The Website is published in Spanish (main version, accessible at unored.es) and in English (accessible at unored.es/en). The Spanish version of this Legal Notice, of the Privacy Policy, of the Cookie Policy and of any contractual conditions is the official and prevailing version. The English versions are provided solely as a courtesy translation; in the event of any discrepancy, divergence or conflict of interpretation between versions, the Spanish text shall always prevail.

5. Conditions of use of the Website

The User undertakes to make diligent, correct and lawful use of the Website and, in particular, to refrain from:

1. Using the Website for unlawful purposes or effects, harmful to the rights and interests of third parties, or which may in any way damage, disable, overburden, impair or prevent its normal use.

2. Introducing or spreading computer viruses or any other physical or logical systems capable of causing damage to the systems of the owner, of its suppliers or of third parties.

3. Attempting to access, use or manipulate the data of the owner, of third-party suppliers or of other users.

4. Reproducing, copying, distributing, transforming, publicly communicating or making available to third parties the contents of the Website without the express written authorisation of the owner.

5. Employing automated data extraction techniques (scraping, unauthorised crawling, data mining or equivalent techniques) on the Website or its contents, or using the contents of the Website for the training of artificial intelligence models, without the express written authorisation of the owner. The owner expressly reserves the rights provided for in article 4.3 of Directive (EU) 2019/790 in relation to text and data mining.

6. Removing, circumventing or manipulating the distinctive signs, trade marks, copyright notices or any technical protection measures of the Website.

7. Using the email addresses published on the Website to send unsolicited commercial communications.

Breach of any of these obligations shall entitle the owner to deny or withdraw access to the Website without prior notice, without prejudice to the exercise of any legal actions that may apply.

6. Intellectual and industrial property

All intellectual and industrial property rights in the Website and its contents —including, by way of example and without limitation, the trade mark and trade name “UnoRed”, the logo, the tagline “Conecta. Crece. Pertenece.”, the graphic design, the navigation structure, the texts, the images, the photographs, the videos, the source code, the databases, the workflows, the templates, the methodologies and the downloadable materials— are owned by the owner or by third parties who have assigned the corresponding rights of use to him, and are protected by Spanish and EU intellectual and industrial property legislation.

The making available of such contents does not in any case imply the transfer of their ownership or the granting of any right of exploitation in favour of the User, beyond that strictly necessary for the personal and non-commercial use of the Website.

The reproduction, distribution, public communication, transformation and any other form of exploitation, in whole or in part, of the contents of the Website without the prior, express and written authorisation of the owner are expressly prohibited.

Any User who considers that any content of the Website infringes his or her intellectual or industrial property rights may report this to legal(at)unored(dot)es, indicating the identifying details of the rights holder, the precise location of the content and the justification of the ownership claimed.

7. Links

7.1 Outbound links

The Website may contain links to third-party sites. The owner does not control those sites or their contents and assumes no liability for them, for the information they offer, for their availability, or for any damage that may arise from accessing or using them. The inclusion of a link does not imply any relationship, recommendation, sponsorship or verification of contents.

7.2 Inbound links

The establishment of a link to the Website does not confer any relationship between the owner and the owner of the linking site, nor does it imply acceptance or approval of its contents. Links are not permitted from pages whose contents are unlawful, denigratory, contrary to fundamental rights or which harm the image of the owner or of the UnoRed brand. The link must point to the home page and may not reproduce the Website by means of framing or create confusion as to the origin of the contents.

8. Informative contents, prices and absence of guarantees of results

8.1 Informative nature

The information published on the Website is purely informative and educational in nature. It does not constitute professional advice of any kind (legal, tax, accounting, financial or technical) nor a binding offer, unless expressly stated otherwise.

8.2 Prices

The prices shown on the Website are expressed in euros and do not include Value Added Tax (VAT (IVA)), which shall be applied at the rate legally in force at any given time and shall be detailed in the corresponding invoice. Plan prices are shown for indicative purposes and do not constitute a binding offer; the final price, the scope of the service and the applicable conditions shall be set out in the contractual document signed with each client. The owner reserves the right to modify its prices and its catalogue of services at any time in respect of future contracts, without this affecting contracts already concluded, which shall be governed by the terms agreed in them.

8.3 Absence of guarantee of results

The Website may describe efficiency improvements, time savings, customer acquisition or other benefits associated with UnoRed’s services. Such descriptions are illustrative and do not constitute a guarantee, promise or commitment to obtain any result. Results depend on factors beyond the owner’s control, including the sector, the location, demand, the database, prior reputation, prices and the client’s own operational involvement. The owner does not guarantee any volume of customers, revenue, bookings, reviews or return on investment.

9. Exclusion of liability

The owner does not guarantee the availability, continuity or infallibility of the operation of the Website and, accordingly, excludes, to the maximum extent permitted by law, any liability for damages of any nature that may arise from:

1. The lack of availability, maintenance or effective operation of the Website or its services, including those arising from failures of the hosting platform or of third-party technology providers.

2. The lack of usefulness, suitability or validity of the Website or its contents to satisfy the User’s specific needs, activities or results.

3. The existence of viruses, malicious or harmful programs in the contents, or of defects in the User’s equipment or system.

4. The receipt, obtaining, storage, dissemination or transmission by the User of contents not belonging to the owner.

5. The unlawful, negligent or fraudulent use of the Website or its contents, or use contrary to this Legal Notice.

6. The lack of truthfulness, accuracy, completeness or currency of the contents of third-party websites linked from the Website.

Nothing in this clause excludes or limits the owner’s liability for wilful misconduct, in accordance with article 1102 of the Código Civil (Spanish Civil Code), nor any liabilities that cannot be excluded or limited under applicable mandatory legislation.

10. Tools based on artificial intelligence

The Website and UnoRed’s services may incorporate artificial intelligence systems intended to interact with natural persons, such as conversational assistants or telephone answering agents. In compliance with article 50 of Regulation (EU) 2024/1689 (Artificial Intelligence Act), such systems are identified as artificial intelligence systems from the outset of the interaction. Detailed information can be found in the Policy on Transparency in the Use of Artificial Intelligence and in the Privacy Policy.

11. Protection of personal data

The processing of personal data collected through the Website is governed by the provisions of the Privacy Policy and, as regards cookies and tracking technologies, by the Cookie Policy.

12. Commercial communications

In accordance with article 21 of the LSSI-CE, the owner does not send commercial communications by email or by equivalent electronic means of communication that have not been previously requested or expressly authorised by their recipients, save in the cases covered by article 21.2 of that legislation.

All commercial communications sent by the owner are identifiable as such, identify the sender and include a simple and free-of-charge objection procedure, available both at the time the data is collected and in each communication. The User may object at any time by writing to legal(at)unored(dot)es or by using the unsubscribe link included in each communication.

13. Modifications

The owner reserves the right to modify at any time and without prior notice the presentation, configuration, contents and services of the Website, as well as this Legal Notice. Modifications shall take effect from their publication. The User is advised to review this document periodically. The date of last update appears in the heading.

14. Partial invalidity

If any of the clauses of this Legal Notice is declared void, unlawful or unenforceable, in whole or in part, by a competent body, that clause shall be deemed not to have been included and shall not affect the validity and enforceability of the remaining clauses, which shall remain fully in force. The affected clause shall be replaced by another valid clause pursuing the economic and legal purpose closest to the original.

15. Applicable law and jurisdiction

This Legal Notice is governed by Spanish law.

For the resolution of any dispute arising from access to or use of the Website, and given that these are relationships between businesses and professionals, the parties expressly submit, waiving any other jurisdiction to which they may be entitled, to the Courts and Tribunals of the city of Valladolid (Spain), in accordance with article 54 of Ley 1/2000, de Enjuiciamiento Civil (Spanish Civil Procedure Act).

The foregoing is without prejudice to the non-waivable rights that sectoral telecommunications legislation grants to end users who are natural persons, self-employed professionals or micro-enterprises, including the possibility of resorting to the out-of-court dispute resolution procedure provided for in article 78 of Ley 11/2022, de 28 de junio, General de Telecomunicaciones (Spanish General Telecommunications Act), before the Oficina de Atención al Usuario de Telecomunicaciones (Spanish Telecommunications User Support Office) of the competent Ministry.

16. Complaints

Any complaint relating to the Website or to the services may be addressed to legal(at)unored(dot)es or submitted through the contact page. The owner shall acknowledge receipt and resolve the complaint as promptly as possible.

In the case of electronic communications services, if the complaint is not satisfactorily resolved within one (1) month, an end user who is a natural person, self-employed professional or micro-enterprise may contact the Oficina de Atención al Usuario de Telecomunicaciones (https://usuariosteleco.digital.gob.es) within three (3) months of the response or of the expiry of that period.
